I got into a car accident?

I was sitting at a red light and got rear ended by a drunk driver at approx 35 mph. I was wearing a safety belt. I was taken to hospital, and he was taken straight to jail for his 4th DWI conviction. I suffered the normal whiplash injuries, but also herniated and ripped a disk in my lower back that was not preexisting. My insurance company had me evaluated by their MD, and he concurred it was not prexisting. I have a personal injury lawyer who seems quite professional. I live in New York State which means all of my medical bills have been paid via no-fault insurance. However I’d like to get a large recovery mainly because i am so mad that he is a 44 year old man, and hitting me gave him his 4th dwi. I also had my job filled because I was out for so long healing. I used to be an emergency nurse for the government. Does anyone think i will get a good recovery despite having all medical bills paid by no-fault. My lawyer seems quite confident, but I have a bad feeling i’m not "hurt enough". Thanks everyone.
I forgot to mention that I haven’t received any insurance payout from his company. My attorney is demanding a settlement amount from his insurance company. His insurance company has not offered me anything as of yet.

I was awarded 2.2 million dollars against a drunk driver that injured me for the rest of my life. It was a default judgement in the state of Missouri as the guy never responded. We have waited a yr so that he could not try to come back and contest it. My question is what can they collect from him, and how. I was also told he cannot file for Bankruptcy to try and get away from it?

Reinstating my license after DUI?

Ok so, I recieved a DUI in June 2009 and lost my license and totaled my car. I was hit by another drunk driver. Careless, I know and have since learned a very valuable lesson in drinking and driving. I never got my license reinstated because I don’t have a car to drive. I am now trying to reinstate my license and was wondering what the step are needed to get it done. I live in Colorado by the way. So far, I have filled out a Reinstatement Form along with reinstatement fee, my Discharge Refferal Summary (stating that I have completed my Alochol and Level 2 Education program). But since I do not have a car what other paperwork do I need in order to recieve my license? Can my husband put me under his car insurance so I can obtain an SR22? Can I even get a valid license if I fill out a Non-Owners Policy Form? Is there a penalty for reinstating so late after 2 years? What are my options??? Thanks!

Drunk driving laws?

I have been doing some research.
I know that you have heard about people being convicted multiple times of drunk driving. Do you know that 17,000 people are killed and 500,000 people are injured. every year by drunk drivers.
The only time these drivers go to jail is when they kill someone.
If they are convicted, of simply injuring someone, all that happens is their license is suspended. So next time they drink and drive, they do it without a license.
If caught, they get a conviction of driving without a license, and dwi, then released.
As a former EMT, I would get very irritated when running a drunk driving accidents, and the drunk driver would be out walking around, and I would have to treat innocent people, even kids that this driver struck. The police would do their sobriety tests, and arrest them for dwi/dui Then a few weeks later, the same incident, with the same person.
Can someone explain to me why, a person has to be killed to put theses people in jail?

I know the prisons, and jails are overcrowded. But there has to be a solution to this problem.
Any comments ideas welcome.
Any law enforcement, lawyers, and judge’s etrc. that can explain why people can be convicted over, and over of DWI,dui etc. and put back on the road?

My parked car was hit by a drunk driver who fled the scene (leaving his car there). There was a witness but he only saw the idiot run, not the actual accident. The idiot tried to report the car stolen 1/2 hr later. If he is successful and they say it was stolen, which insurance coverage comes into play? I have collision and comprehensive but not uninsured motorist coverage. Also, if he is found to be responsible but does not have insurance, would my collision/comprehensive cover that?

I was driving home and a drunk driver rear ended me… twice. The second hit came as we were pulling over to exchange info. People that witnessed it stopped cause they thought he e was a pissed bf. Any way car got totaled i j went through 6 month rehab and now its time to settle. 6400 for the med bill and 8000 for me. Good deal?

It would still fall under DWI (driving while impaired) and can serve a minimum jail sentence. It has been proven time and time again that sleep-deprived drivers are just as dangerous, if not more, than drunk drivers. So, if there was a way for police officers to know if a driver hasn’t slept in the past 24 hours (newly engineered technology soon to come), would you be in favor in a law that would charge the driver with a DWI (driving while impaired) but receiving the same sentence and suspension as a drunk driver?
