I can’t even get cops to give me consistent answers. One says "The Pedestrian ALWAYS has the Right of Way", another says if the pedestrian was in violation of a "Don’t Walk" signal, the the pedestrian was wrong, but if there had been a collision, then BOTH parties are in the wrong, another says if the pedestrian was jaywalking then it’d the pedestrian’s fault if he/she gets hit – Is this a completely subjective question?

Does one have to consent to field sobriety tests?

Legally speaking, if you’re pulled over and the officer suspects you for DUI are you required by law to consent to a field sobriety test? It’s my understanding that they are not legally enforceable (meaning that just b/c the cops want you to do one you can tell them no). I understand that, at least in AZ, you have to consent to a breathalyzer or lose your license for 1 year. But what about those goofy FSTs? Aren’t they just coordination games that will only lead to a cops probable cause? And if you refuse to take a FST is there any repercussion?

I was outside at a party, no drink in my hand, and cops raided the party. I refused a breathalyzer test and was arrested. I was let out of jail without any bail. I am 18 and live in Illinois. Can I plead not guilty since I didn’t take the breathalyzer and I didn’t have any alcohol near me? I am afraid I will lose my drivers license because of the harsh driving laws in Illinois for drivers under the age of 21. Any help would be appreciated.

For example, I know that when a minor is pulled over, the cop can give the minor a breathalyzer test to see if the minor is intoxicated. But can cops force a breathalyzer test on you in other circumstances. For example, can passengers of a car be breathalyzed? If the driver passes the breathalyzer test will the passengers be breathalyzed? Outside of a concert can a cop give you a breathalyzer test? Im asking because a friend was subjected to a breathalyzer test even though he was a passenger in a car. The test resulted in a MIP because he had been drinking…

Failing Breathalyzer Test?

I currently live in ohio and was just in union pier, michigan for the past couple days. We were on the beach drinking and lighting off fireworks. There were beer cans everywhere. The cops came down and gave everyone a breathalyzer test. I got blew a .001, while some people got .06′s. I barely had any beer. Is there anything I can do to keep this off my record? I heard there is a diversion program for 1st time offenders and they take it off your record. Or would it be a good idea to fight it and say its breathalyzer error? The cop wrote down on the ticket "admitted to drinking over 1/2 a beer" when i didnt even say that. He asked "did you drink about 1/2 a beer?" and i replied with "not even that". What should i do?

If you have had both tests done by a police officer, please tell me what the results were and how far apart the tests were taken. I’m wondering about the accuracy of the breathalyzer test. My bf was drinking the other night. This one girl really needed a ride home and he was the only one who could give her one. He waited about an hour and tried sobering up and drinking a lot of water. He didn’t want to drive so soon but he felt bad for her. Now please don’t start going off on how dumb he is for drinking and driving because I know someone will but its pointless now… he rarely drinked to begin with and hes done drinking now. On the way there, my bf was pulled over because he needed some car repairs. He tested a 0.08 on the breathalyzer the first time. He passed a field sobriety test without any trouble. They cops had him sit around for like 15 minutes and had him take it again. The breathalyzer gave a reading of 0.09 the second time. They drew blood shortly after. I’ve been reading online about a margin of error with these breathalyzers. I wonder if the blood test could give different results. Also, my bf is a pretty big guy.. 6’3 260 pounds, so I’m wondering if a large body size could give a false positive on the breathalyzer test. If his blood test gives results under 0.08, hes off the hook without a DUI because the cops didn’t report anything wrong with his driving and because he passed the field sobriety test. What are your experiences if you’ve had those tests done? Were the results different from each other?

I am fighting a traffic ticket, but the officer was really nice, do cops get in trouble, if they lose in court?

After almost a 2 year translating job in Afghanistan, I came home. EXCITED, EXHAUSTED after a 15 hour flight on a military plane — I was a little out of it. So I made a mistake and got off the wrong exit. Well in trying to get back onto I75 North–I turned into an HOV entrance to the freeway. The cops were waiting down at the entrance of the freeway. They asked me for my license and proof of insurance. I tried to explain to them I have insurance but I don’t have a current "proof". But the cop had stopped so many people, I counted 7 cars and counting, including a tractor trailer—-that he didn’t wait on me as I was trying to pull up the insurance card on my iphone.

My car was left for me by family at the airport. I couldn’t tell the exactly what day I was going to arrive so they left the car there for about a month.

I went to court on the 25th and they sold me the idea that it would be great if I just plead "nolo" and paid their "fee". I did but decided on paying the fee at a later to reconsider maybe a trial.

I’m very concerned that any negative marks against my driving record may affect my next possible deployment.. I’m contract—they’re VERY critical and check our records routinely. Previous to these 2 tickets (no proof of insurance, turning into HOV), my record was immaculate..

I would love to know what to do from here?
Atlanta Georgia, Fulton county to be specific..
I’m also being charged 0.00 for "no proof of insurance" —- ridiculous.
