Friend of mine got pulled over last and he refused a search but they went ahead and searched the car anyway and found a grinder, weed (less than 35g), and a pipe in Missouri. They let him go home without a ticket but they said they would mail him to go to court soon. What you think worst case scenario is?
He wasnt drinking. They had him take a blood test at a hospital too.

not producing or uptaking one chemical or another without blood test or something?
I mean it takes several weeks to get any benefit from the medications and if your brain needs dopamine not sarrotonin is it just trial and error [syptoms] for a year or so until the doctors has written every new or old meds that the Big Drug Companys push or should I say "wants the Dr.to try pushing them on patients" without Any Real Test or Something to figure out WHAT the brain is low on in the first place….This sure seems more logical to me and less debilitating for the patient Who needs help Now not later ..By the time one who may have been told they need meds to overcome the health problem they May have,It,s pretty likely they will just give up on the professional and resort to drugs/no help at all which can be worse than Drugs & alcohol together &driving off a cliff..Big Buisness sucks! why do Doctors follow along like blind monkeys with their hand in the scamBag too?

went to the police station. blew a couple tests and they kept messing up then she was asking for her dad or a lawyer to be there for the blood test and they wouldnt let. but still took blood

In early April, I got arrested for DUI. I took a blood test while there and am still waiting for the results. I drank 5 beers and took one shot that night. I started drinking at 7, stopped at 11 and by the time I took the blood test, it was about 12:30 a.m.

Anyway, I just graduated from college with two degrees and an almost perfect GPA. Needless to say, I regret this more than anything in my life and would never ever do it again.

** as of now, the case has not even been filed against me (it takes a while) and i have not received my blood test results

My problem is that now I need a job. I already have an offer from my internship, but I don’t want to work there anymore, I want to work for a more corporate environment. I’m interviewing for three fairly selective opportunities, I think I will get offers, but I don’t know if everything will be okay with background check afterward.

I know this is a wrong thing to do, but should I accept my current job’s offer and delay my start date to pursue one of those other three opportunities? I feel really, really badly about it, but I don’t want to end up with nothing at all. And my internship is in a fairly small industry, so I’d have to keep out of that industry, but it won’t affect more corporate companies.

Normally, I would have turned down my internship’s offer honestly and fairly, but now I feel boxed in because of the DUI stuff, and I hate that I feel like I have to do this.

Answer these questions?

A. Based on the drinks I’ve had and the timing of the test, is there anyway I could have been under the .08 limit?

B. Should I take the offer from my internship and not take the job if I get a better offer?

C. Will employers not hire me if they see the open DUI case? (even though I haven’t been convicted)

D. Other suggestions?

I’m a little embarrassed to ask this, as I have worked in law enforcement for a while, and I should know the answer. However, I got into conversation with my sergeant and our prosecutor over it (both have two very different answers), and I’m just wondering, does the person know that their blood is being tested in the hospital for this, and if so, can they refuse?

If a person is arrested for OUI (DUI in some states), they can refuse the breathalyzer test. Of course, when they do, their license is revoked for a set period of time. However, if that person is transported to a hospital, (assuming they are conscious) and their blood is drawn, that blood test can be admissible in court to determine the blood alcohol content. Is the subject aware that when they are having blood taken, that this can be done. Can they refuse to have their blood tested for this?

On one hand, you have a person who has already refused an alcohol test; therefore they have refused “any alcohol testing”. The person may not be aware that the blood test is being used for this (and they have not authorized it). They are under the impression that the blood is being taken for medical treatment, and they are to assume that it would only be used for that purpose. Then, on the other hand, you have someone who "donated" their blood to the hospital for "further testing" – does that general term cover testing that is used for this reason? I know it states that the hospital can release information to third parties, so I’m assuming law enforcement officials would be covered in that.

Is the person made aware, at the hospital, that their blood sample can be used to determine blood alcohol levels and the results can be released to the police, and if so, does that person have the right to refuse to have that tested (in the event of a non fatality)? Or is that information that isn’t voluntarily given to the subject by the ER staff? Do they assume that if you don’t ask them directly, then they don’t have to tell?

A friend of mine was fired for violating company policy-being under the influence of alcohol above 0.02level. He was asked to take the breath test and it came out as 0.04 and the state (Ohio) BAC level is 0.08. Is breath test as conclusive as Blood test to really determine the Blood Alcohol Concentration level? And,for being fired for the reason stated above, is he eligible for unemployment pay? Thank you for your honests answers.

I live inn Humboldt county. I was told that I was one and a half times the legal limit. I took a blood test. I don’t know the results, yet. But I assume they support the officer’s claim. It is my first offense. I was very cooperative.

If you have had both tests done by a police officer, please tell me what the results were and how far apart the tests were taken. I’m wondering about the accuracy of the breathalyzer test. My bf was drinking the other night. This one girl really needed a ride home and he was the only one who could give her one. He waited about an hour and tried sobering up and drinking a lot of water. He didn’t want to drive so soon but he felt bad for her. Now please don’t start going off on how dumb he is for drinking and driving because I know someone will but its pointless now… he rarely drinked to begin with and hes done drinking now. On the way there, my bf was pulled over because he needed some car repairs. He tested a 0.08 on the breathalyzer the first time. He passed a field sobriety test without any trouble. They cops had him sit around for like 15 minutes and had him take it again. The breathalyzer gave a reading of 0.09 the second time. They drew blood shortly after. I’ve been reading online about a margin of error with these breathalyzers. I wonder if the blood test could give different results. Also, my bf is a pretty big guy.. 6’3 260 pounds, so I’m wondering if a large body size could give a false positive on the breathalyzer test. If his blood test gives results under 0.08, hes off the hook without a DUI because the cops didn’t report anything wrong with his driving and because he passed the field sobriety test. What are your experiences if you’ve had those tests done? Were the results different from each other?

My BAC blood test came out to be 0.09 just slightly above 0.08 legal limit.

What are my chances of getting my charges reduced to reckless driving or dismissed or reduced to anything other than DUI?
