My sister is a good person who made a mistake. She has 3 children a job and is planning to finish college. She is 26 years old. Would the judge consider your great background in a DUI case. If you never had any priors or no one was injured. She had 3 drinks and was arrested after a car ran into the back of her. She side swiped another car and didnt notice until after she was arrested. How much would your BAC be if you had 3 Mixed drinks (not straight liquor) If they took your blood 4 hours later and there was no breathalyzer. She fell asleep in her cell and they transported her to the hospital. She had just gotten off of work and was sleepy behind the wheel. She also ate a burger and fries while consuming the drinks would this affect anything ?

The da dropped my dui charge to a dwai and my bac was .148. Will the dmv express consent hearing still take my license due to my bac or will they treat it as a dwai, and only take 8 points from my license? if this is the case will I need to accept the plea agreement before my hearing?

I have noticed, through what I would consider carefully considered trials, that as I become intoxicated I began to see double. As far as the scope of this question is concerned, it is most noticeable when becoming intoxicated while watching TV. When I start seeing double on the TV there is nothing I can do about it except to close one eye and view the TV screen with one eye. No matter how hard I concentrate, I cant erase the double vision, once it starts, by concentration alone. And when I look for it once I notice it I can also see that it involves not only the TV screen but everything, at least everything within the scope of my vision in my room. So why does that happen, and why can’t I overcome it by knowledge that it is occurring? It’s weird. Thank God I know about it and that I don’t try to drink and drive. Imagine what would happen to someone driving intoxicated on the open road who started seeing double and didn’t know why! Does it happen to everyone when they become intoxicated past a certain BAC? I wear glasses for the correction of farsightedness an Astigmatism but it occurs with and without my glasses in place. What’s up with that eh? Does anyone know why it happens?
IDK y’all. I know it’s because I drank too much. That’s the obvious answer that even I knew. But why does it happen? You smart asses think you are funny no doubt. How about a more serious answer?

I got a .19 BAC on Jan 08 and I belive after Jan 11 I couldv’e gotten it expunged under Penal Code Section 1203.4a? I did all the classes, payed all the fines, not on any probation, haven’t been arresest ( or gotten a ticket for that matter.) Does anyone know what I have to bring in, and who do I file with, how much will it be and how long will it take?

I recently got charged with a DUI in Arizona. I have hired an experienced attorney to represent my case. My DUI did not involved any serious damage or accident. I dont even think the cop had a probable cause to stop me because I did not have any traffic violation. My BAC was 0.09. I would like to know what is considered as a weak evidences or an example of a weak case?

i was pulled over for dwi…first offense (.11 BAC) i have the name of a lawyer who is supposed to be the best but he’s 5,500 plus fees for expert witness etc. another lawyer, who i don’t have any info on, is 2,500. i’m unemployed..i need the charge to go away but is spending more on the lawyer more of a guarantee of a better outcome?

My little sister just got her first DUI over the weekend in Phoenix Arizona. She doesn’t know her BAC yet, since they didn’t give her immediate results of the blood test, but she was assigned an Aggravated DUI since her license was suspended.

Her license was suspended because she had unpaid tickets and failed to show proof of insurance. I went with her to the courthouse today to pay the ticket and prove that she had insurance, so we got her license reinstated. My question is if they will drop the DUI down to one of the misdemeanor charges (regular, extreme, super extreme). She has no prior problems besides the suspension, and she had thought it was paid off (she gave the fine money to roommate — already know how stupid that was).

We plan to get an attorney once she has her status hearing, but I wanted to know if there was anyone with experience out there who could say whether or not it’s likely it’ll be dropped to the lesser court, or if the felony conviction will stick.

Ok I was arrested for DUI. I wasn’t given a breathalyzer (just a Urine I consented to) I wasn’t pulled over I was at a complete stop because i was rear ended and a guy would not give me his insurance info. the cop came gave me an eye test and immediately put me in cuffs. I only had 2 drinks (mixed no shots) I was coherent! He parked by car at the side of the road first then drove me to jail. I went to sleep of course I wasn’t afraid of being in jail because he was wrong and i will get a DUI Lawyer. He made me go to the hospital hours later. He said to make sure I was ok. I got there and told the nusre I had a drink but I was not drunk. She said they did NOT take my blood. Is she lying ? I was given an IV. I told her i was exhausted and wanted to go to sleep after I gave her a urine sample. She told me they just tested me for pregnancy and throw the urine away (this was hours after my arrest) When i was sleep do you think they took my blood ? I would wake up if someone was sticking me! I am trying to fight this DUI with a skilled dui attorney. Will they use my urine in court ? Or subpoena my hospital ER record in which I wasn’t given a blood test to my knowledge. Without my BAC how the law operates. I have no idea if i was over or under the legal limit. It is not against the law to drink and drive it’s against the law to be "DRUNK" and drive…Should I fight this ? The officer also thought I was on drugs. I was arguing with the guy who rear ended me He had NO INSURANCE. Police let him go
